The company claimed that \u201cTHE WEEKND\u201d was graphically and phonetically similar, and that the overlap in Class 25 (clothing) increased the likelihood of confusion.<\/p>\n\n\n\n<p><strong>TMO\u2019s analysis<\/strong><\/p>\n\n\n\n<p>The Office dismissed the opposition, stating that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>While the trademarks share similar visual elements (\u201cWEEKEND\u201d), they are distinguishable as a whole, especially due to the presence of \u201cTHE\u201d and the unique phonetics of the artist\u2019s name.<\/li>\n\n\n\n<li>There is no significant overlap in the signs, distribution channels, or target consumers.<\/li>\n\n\n\n<li>\u201cTHE WEEKND\u201d clearly refers to a globally known stage name, supported by a signed letter of consent from Abel Tesfaye himself.<\/li>\n\n\n\n<li>From a substantive legal standpoint, there was no evidence that the mark<\/li>\n\n\n\n<li>was unregistrable due to confusion or lack of consent.<\/li>\n<\/ul>\n\n\n\n<p><strong>Conclusion<\/strong><\/p>\n\n\n\n<p>The TMO ultimately rejected Tricot S.A.\u2019s opposition and allowed the registration of \u201cTHE WEEKND,\u201d thereby strengthening the artist\u2019s brand presence in the Chilean market under his globally recognized identity.
